iMCheck Terms of Service

Terms governing the iMCheck App, the Notebook Detector laptop inspection software and related services, including the respective roles of US3C and SEADRCH.

Governing language: This English text is a reference translation provided for convenience. The Traditional Chinese version is the binding version; in the event of any discrepancy or dispute over interpretation, the Traditional Chinese version prevails.

Roles of the parties: US3C operates the iMCheck service and is the transaction party for appraisal, purchase, payment, logistics and returns, and is responsible for generating, sending and verifying OTPs. SEADRCH provides the iMCheck App, the Notebook Detector laptop inspection software and the underlying technology, and processes the necessary data on US3C's lawful instructions. SEADRCH does not participate in or determine final device valuations, purchases, payment, logistics, returns or physical custody. The App is published under a SEADRCH developer account, which does not make SEADRCH a party to those transactions.
1. Scope and Acceptance

These Terms apply to the iMCheck App, the Notebook Detector laptop inspection software, related websites and device inspection interfaces, and the appraisal, recycling and related services provided or arranged by US3C (collectively, the "Services"). By tapping to accept, completing mobile number verification, using a feature that requires consent, submitting inspection or appraisal data, or placing an order, you confirm that you have read and agree to these Terms and the iMCheck Privacy Policy.

Where an individual order, campaign, sales channel or delivery method sets out express terms to the contrary, those individual terms prevail; this does not affect consumer rights that may not be excluded in advance by law. If you do not agree, please do not use the features that require acceptance of these Terms.

2. Eligibility, Information and Mobile Verification
  1. You must have the legal capacity to enter into the relevant transactions. Minors and persons under guardianship or assistantship must act with the consent or assistance of a legal representative or other legally authorized person.
  2. The mobile number, device information and any other information required for specific transaction features must be true, accurate and complete, and you must not use another person's information. For general users completing mobile verification, SEADRCH does not require a name or email address.
  3. iMCheck transmits the mobile number and OTP you enter to US3C. US3C is responsible for generating, sending and verifying the OTP. Processing and retention of mobile numbers and OTPs are governed by the iMCheck Privacy Policy.
  4. You must safeguard your OTP, the device you sign in from, and your inquiry information, and must not sell, lease, transfer or otherwise provide them to others to circumvent usage restrictions.
  5. Enterprises, retail stores, distributors and other legal entities must not use a general user account to circumvent enterprise licensing or controls on usage counts, terms, locations or permissions.
3. Device Inspection and Preliminary Appraisal

iMCheck and Notebook Detector generate inspection results or preliminary appraisals based on the device model, operating system, permissions, sensors, hardware information, test results, the condition you declare, and the data available at that time. Results may be affected by the environment, operation, prior repairs, replaced parts, system limitations, third-party services or device faults. They are provided solely as a reference for evaluating a transaction and do not constitute any warranty as to the device being free of defects, or as to its authenticity, ownership, value, repairability, tradability or future condition.

Preliminary appraisals, their validity period, physical re-inspection, price adjustments, order formation, cancellation and return conditions are governed by the transaction rules displayed by US3C at the time of use and by the individual order. Where the physical condition of the device does not match the declared or inspected data, US3C may propose an adjusted price, and you may decide whether to accept it in accordance with the applicable rules.

4. Transactions, Delivery, Payment and Logistics
  1. The point at which a transaction is formed, the transfer of title, the allocation of risk, custody, shipping, cancellation and returns are governed by the individual order and the content expressly stated on the transaction pages.
  2. Purchase payments, invoices, taxes, logistics claims, loss of or damage to a device, returns and transaction disputes are the responsibility of US3C or of the actual transacting party expressly identified on the relevant page.
  3. SEADRCH provides only the necessary system records and reasonable technical assistance within the scope of lawful authorization, and bears no responsibility for transaction consideration, payment, logistics, custody or physical devices.
5. User Representations and Obligations Before Handover
  1. You hold lawful ownership of, or the right to dispose of, the device you submit, and the device is not stolen, lost, fraudulently obtained, or subject to the rights of any third party.
  2. Before handover you must back up any data you need, sign out of your accounts, remove activation locks and device management, and remove the SIM card, memory card and accessories as instructed.
  3. You must truthfully disclose repairs, modifications, replaced parts, liquid damage, locks, account bindings, malfunctions and any other circumstances that may affect inspection, appraisal, the transaction or safety.
6. Prohibited Conduct
  • Reverse engineering, decompiling, disassembling, cracking, intercepting or scanning unauthorized interfaces;
  • Circumventing licensing, permission, security, usage-count, term, location or other technical controls;
  • Distributing malware, making high-volume automated queries, interfering with the Services, or accessing data without authorization;
  • Impersonating another person, providing false information or a misrepresented device, or using the Services for fraud or other unlawful acts;
  • Infringing intellectual property rights, trade secrets, personal data or the rights of third parties;
  • Using the Services, their inspection logic or their output to develop, train, test, validate or promote a competing product without written authorization.
7. Software License and Intellectual Property

For as long as you comply with these Terms, SEADRCH or the relevant rights holder grants general users a limited, personal, non-exclusive, non-transferable and non-sublicensable right of use, revocable in accordance with law, solely to use the consumer edition of iMCheck or the expressly provided Notebook Detector features on supported devices and to receive services from US3C. Enterprise, retail and other commercial users must additionally operate within the scope of SEADRCH's written authorization, accounts and licenses.

The software, source code, architecture, algorithms, models, interfaces, database structures, inspection logic, APIs, technical documentation, and all updates and improvements thereto are owned by SEADRCH or its licensors. The iMCheck name, trademarks and brand assets belong to their lawful rights holders. Except as expressly licensed, you acquire no source code, commercial use rights or other intellectual property rights.

8. Third-Party Services

The Services may connect to Apple, Google, cloud, SMS/OTP, push notification, map, logistics, payment or other third-party services. The availability of third-party services and their data processing and terms are determined by their providers. To the extent permitted by law, neither party is responsible for the effects of third-party outages or policy changes that are not attributable to US3C or SEADRCH.

9. Data Erasure

Where an individual transaction includes data erasure, the entity actually performing it, the software version, the applicable devices, the method, the standard and the report are as recorded in the order or the erasure report. Absent verifiable grounds, no absolute assurance such as "all data is certain to be unrecoverable" is given. Erasure of data on a device does not mean that transaction, accounting, audit or system records must be deleted at the same time.

10. Suspension, Restriction and Termination

In the event of unauthorized use, fraud, information security risk, unlawful instructions, infringement, interference with systems, or circumstances that may cause material harm, US3C may suspend an account or transaction, and SEADRCH may suspend the affected technical access, APIs, accounts, features or versions in order to protect its systems, licensing, app store standing or data security. Where notice, an opportunity to cure, or an appeal process is required by law, it will be provided accordingly.

11. Changes to and Interruption of the Services

US3C may adjust its services as required by law, transaction processes or service needs. SEADRCH may adjust the technology as required for maintenance, security, vulnerabilities, operating systems, app stores or third-party policies. Materially adverse changes will be notified via the App, the website or other reasonable means; where separate consent is required by law, it will be obtained separately.

To the extent permitted by law, no party is liable for delay or interruption caused by natural disaster, war, government measures, telecommunications or cloud outages, third-party attacks, changes to app store or operating system policies, problems with user equipment, or other causes not attributable to it.

12. Allocation of Responsibility
  1. Transactions, appraisal, payment, logistics, custody, returns, invoices and consumer service are the responsibility of US3C or of the actual transacting party expressly identified on the relevant transaction page.
  2. SEADRCH is responsible only for the software technology within its control and for liabilities that may not be excluded by law. Publishing the App, hosting the website or providing technical assistance shall not be construed as SEADRCH assuming the operational or transactional obligations of US3C.
  3. No disclaimer or limitation of liability applies to liability that may not be excluded in advance by law, or to intent or gross negligence, and none limits the rights consumers enjoy under law.
13. Personal Data and Consent Records

The processing of personal data and the exercise of related rights are governed by the iMCheck Privacy Policy. To evidence the content of your consent and to maintain authorization and security, the system may retain the version of the terms accepted, the time of consent, the App version and necessary technical records as permitted by law; OTPs must not be retained in consent records.

14. Versions and Amendments

These Terms are published with a fixed version number and effective date, and prior versions are reasonably archived. Material amendments will be notified before they take effect via the App, the website or other reasonable means; where separate consent is required by law, it will be obtained separately. A new version does not retroactively alter the substantive rights and obligations of transactions already formed. This page is hosted on a SEADRCH domain, which does not alter the respective roles and responsibilities of US3C and SEADRCH.

These Terms are governed by the laws of the Republic of China (Taiwan). Disputes should first be raised with the relevant customer service team; jurisdiction over litigation follows the applicable law and does not restrict a consumer's statutory right to choose a court.
